The Punjab government's decision to release Hafiz Saad Rizvi, head of the banned Tehreek-e-Lubaik Pakistan (TLP), has been challenged in the Supreme Court.
According to correspondent Shehzad Malik, a two-member bench of the Supreme Court headed by Justice Ijaz-ul-Ahsan will hear the petition at the Lahore Registry of the Supreme Court on Tuesday.
Recently, the Lahore High Court had quashed the detention notification of Saad Rizvi at the request of his uncle and the Punjab government has made him a party in the petition filed in the Supreme Court on Monday.
The petition said that the order issued by the Lahore High Court to release Saad Rizvi did not meet the legal requirements.
The Punjab government is of the view that a detailed record of the case was also provided to the apex court and that the government's decision to detain Saad Rizvi was legally correct.
The provincial government has requested the Supreme Court to quash the decision of the Lahore High Court to release Saad Rizvi.
It may be recalled that after the order of the Lahore High Court, the district administration had issued orders for the release of Saad Rizvi from Kot Lakhpat Jail, however, his release has not been implemented yet.
A statement issued by Lahore Deputy Commissioner Omar Sher on Saturday said that they were allowing the immediate release of Saad Rizvi.
Omar Sher has confirmed the statement citing the recent decision of the Federal Review Board (FRB) for the release of Saad Rizvi and the decision of the Lahore High Court in this regard.
It may be recalled that Saad Rizvi, who became the head of the religious party TLP after the death of his father Khadim Rizvi, was earlier detained on the orders of the federal government under the MPO (Public Order) Act. He was also jailed under Section 11 Triple E of the Anti-Terrorism Act.
'Assurance must be given before release'
Lahore Deputy Commissioner Omar Sher said that the declaration for the release of Saad Rizvi was issued by him with reference to the same section of anti-terrorism under which the Punjab government had arrested him.
He said that in order to be released from jail, the TLP chief would now have to submit a bond to the police in which he would assure them that he would not be involved in any of the activities that led to his release. Was arrested. "At the same time, it has to be seen that there are no other cases registered against him in which he is wanted by the police."
Earlier, the Punjab government had withdrawn Saad Rizvi's request for extension of detention in the Federal Review Board. The review board had issued orders to release Saad Rizvi if he was not wanted in any other case.
A three-member board headed by Supreme Court Judge Justice Maqbool Baqir heard the case at the Lahore Registry of the Supreme Court.
It may be recalled that Saad Rizvi was re-arrested on July 9 this year on a notification issued by the federal government under anti-terrorism provisions.
He was to be released on the same day as the High Court's review board had rejected the Punjab government's request for extension of Saad Rizvi's detention under the MPO.
